EULA - End User License Agreement

SOFTWARE - LICENSE AGREEMENT
WITH ENGINEERING OFFICE RICHTER

for end-user of the software packet GLOBAL FLEET CONTROL 40

ATTENTION: THE USE OF THE SOFTWARE PACKAGE GLOBAL FLEET CONTROL IS SUBJECT TO THE CONDITIONS OF THE FOLLOWING SOFTWARE LICENSE CONTRACT OF THE ENGINEERING OFFICE RICHTER. IF YOU USE THE SOFTWARE, YOU EXPLAIN THEREBY YOUR AGREEMENT WITH THE REGULATIONS OF THE FOLLOWING LICENSE AGREEMENT. IF YOU DO NOT AGREE WITH THE LICENSE AGREEMENT, YOU HAVE THE ABILITY TO RETURN THE ENTIRE, UNUSED PROGRAM PRODUCT, INCLUSIVE DOCUMENTATION, AGAINST THE PURCHASE PRICE. THIS PRESUPPOSES HOWEVER THAT THE CD-ROM AND THE SOFTWARE DOCUMENTATION ARE STILL IN THE UNOPENED ORIGINAL PACKAGING).
If you have no other and signed agreement with the ENGINEERING OFFICE RICHTER, the following license conditions intend your user rights for the enclosed software.
1. GRANTING OF LICENSE the ENGINEERING OFFICE RICHTER grants you a license for the use of one copy of the software. The usage includes storing, loading, installing, running and displaying of the software. You are not justified to modify the software or to deactivate license and control functions of the software. If the software is licensed for multiple usage, not more than the maximum number of authorized users may use the software at the same time.
2. ABSOLUTE TITLE the software is property by ENGINEERING OFFICE RICHTER and/or their suppliers and in copyright matters protected by ENGINEERING OFFICE RICHTER and/or their suppliers. The software is protected by copyright laws of the Federal Republic of Germany, as well as international agreements. This license grants you no requirement or absolute titles at the software and do not justify you to sale the software. The suppliers of ENGINEERING OFFICE RICHTER reserve themselves the right to make with any injury of these license conditions their rights valid.
3. SOFTWARE USE
You may use this software on one individual computer, preconditioned that the software is used at the same time only on one computer. The software is used in a computer, if it is loaded into the main memory (e.g. RAM) or in the permanent memory (e.g. non removable disk) of the computer.
2) The use of the software on several working places presupposes also a multi-place license agreement with the ENGINEERING OFFICE RICHTER.
You may not:
1) make or possess any form of copies of the software, whether digital or in another form

2) place or let place the software in the Internet or another form of online service.
3) change, decompile, analyze the structure of the software or try to find out in another way the source code of the software.

4) produce, change, adapt, translate, lend or lease derivatives of the software.
4. PERIOD
This license is valid for the period, in which you use the software, except it becomes invalid, when you contrary-act the conditions of this agreement. If this license becomes invalid, you agree to destroy the original and all possible copies.
5. LIMITED WARRANTY
THE ENGINEERING OFFICE RICHTER AND ITS FOR SUPPLIER CAN'T GUARANTEE FOR THE ACHIEVEMENT OR THE RESULTS, WHICH YOU REACH BY USING THE SOFTWARE OR THE PERTINENT ELEMENTS. THE ENGINEERING OFFICE RICHTER DOES NOT GIVE OTHER WARRANTIES, EXPRESS OR INDIRECT, REGARDING THE PROTECTION OF THE RIGHTS OF THIRD, OR EFFICIENCY FOR CERTAIN PURPOSES. NO VERBAL OR WRITTEN INFORMATION, OF the ENGINEERING OFFICE RICHTER, ITS DISTRIBUTOR, REPRESENTATIVES OR EMPLOYEE GIVEN, MEAN A DECLARATION OF GUARANTEE.
6. RESTRICTION OF LIABILITY
IN NO CASE IS THE ENGINEERING OFFICE RICHTER RESPONSIBLE FOR ANY DAMAGE, INCLUDING LOSS OF PROFIT OR OTHER COMBINED OR FOLLOWING DAMAGE, WHICH COME FROM THE USE OR THE INABILITY FOR THE USE OF THE SOFTWARE OR WRITTEN MATERIALS, EVEN IF THE ENGINEERING OFFICE RICHTER HAS BEEN REFERRED (INSTRUCTED) TO THE POSSIBILITY OF SUCH DAMAGE.
7. TRANSFER
This license ends automatically, if you pass on the software to third. During the transfer you must hand over the software and all copies and pertinent documentations. The receiver must accept these license regulations as transfer regulation.
8. TERMINATION
ENGINEERING OFFICE RICHTER has the right to terminate this license, if you do not consider the conditions specified herein. In the case of termination you must destroy the software as well as all copies, adaptations and parts of the software in any form immediately.
9. EXPORT
You are not justified to export or supply copies or adaptations of the software, if thereby applicable rights or export regulations are hurt.
10. MISCELLANEOUS
This agreement is subject to the right of the Federal Republic of Germany. If any regulations of this agreement are not rightfully, invalidly or for any reason not executable, these regulations are regarded detached of the agreement and they will not affect the validity or feasibility of the remaining regulations of the agreement.
This agreement is the complete issue of the agreement and makes all previous suggestions referring to the content of the agreement or communication with us futile.
